Terms of Service

This policy outlines the conditions of service to our customers regardless of the location the service is delivered from.

Refusal of Service

If you've ever been blacklisted from a THOT service you are prohibited from signing up to our hosted solutions and we reserve the right to terminate your service without warning or refund if we find you evading.

Free Services

THOT will periodically issue out free services to clients in order to test our services, these services will be restored back to the 'Getting Started' tier regardless of whether you previously upgraded from another paid tier.

Billing

Every month, on the service anniversary, we will either:

  • Debit the client's card (when such information has been provided to us during sign up)
  • Debit the client's paypal account using an automatic subscription (when such agreement has been configured by the client at checkout)
  • Send the client, by email or postal mail, an invoice in accordance to the next billing period

You will receive an invoice every month for the billing period where payment shall be made no latter than the due date printed. We are entitled to immediately terminate the agreement for a client's failure to make payment.

It is the client's responsibility to ensure they have sufficient funds to cover the transaction, in the event there is insufficient funds your server will be suspended and an email will be sent explaining this to yourself.

Service Fees

There are times when some services will carry a setup fee, this fee must be paid by the client in order to gain access to the service. If a client terminates an agreement, the client shall be responsible for any outstanding fees owed to THOT and agrees to pay any and all fees incurred by the client.

Services are billed on a monthly basis and the client will be responsible for all fees incurred during the billing period, regardless if termination notice is provided. E.g. A client provides termination notice on the 15th day, the client is responsible for all fees during the month. Such fees will not be pro-rated or refunded.

Account Credit

Account credits can only be traded for THOT plans directly. Credits cannot be traded externally, if found to be trading such credit will be removed without warning.

Refunds

Refunds will never be offered via Paypal claims or disputes. Clients who are within their right should contact support, all clients are eligible for refunds within the first 7 days of purchase. No refunds will be given for non-cancelled recurring payments made through a Paypal subscription as this is the client's responsibility to ensure proper termination.

Every refund claim will be reviewed first, if these issues can be fixed and get fixed we reserve the right to deny such requests. Requesting a refund for a non-functional feature, before contacting support, wil result in denial. Services will not be partially refunded under any circumstances.

In cases where our AUP has been violated, any and all refunds are forfeit. We reserve the right to withhold a transaction fee of upto 3.5% + 30p on routine transactions.

Dedicated environment clients are not eligile to receive any refunds.

Cancellations

All monthly services must be cancelled with at least 72 hours before the next invoice due date. All quarterly, semi-annually and annual services must be cancelled at least 15 days before due date. You must have all account information to cancel and accounts must be paid in full before the cancellation will be considered complete.

Liability

THOT shall not be liable for any claimed damages, including incidental and consequential damages, which may arise from THOT's servers going off-line or being unavailable for any reason whatsoever. It is the client's responsibility to ensure they have a disaster recovery plan of their own that includes an unexpected vendor outage.

All damages shall be limited to the immediate termination of service.

Violations

Any server found in violation of our AUP should raised as a support ticket on our website. All complaints will be investigated promptly. Failure to follow our ToS or AUP will be grounds for immediate account deactivation.

Acceptance

By creating an account and using our services you agree to the above terms. Upon creation of account you are expected to uphold our ToS and AUP until termination. Failure to comply will result in suspension, termination or in some cases both without refund.

Changes

THOT reserves the right to change this policy at any time, you should refer back to this policy periodically to check for updates.
